Spain’s main tool for unpaid invoices is a dedicated order-for-payment procedure that is widely used before any full trial.

The proceso monitorio

The proceso monitorio lets a creditor claim an undisputed monetary debt, supported by documents, without an upfront trial. If the debtor pays or stays silent, the creditor gets a fast route to enforcement; if the debtor opposes, the matter converts to ordinary or oral proceedings.

Representation

Beyond small amounts, Spanish litigation generally requires both a court representative (procurador) and a lawyer (abogado).

Enforcement

With a title, the creditor applies for enforcement (ejecución), and the court can order attachment (embargo) of accounts, salary or assets.

Cross-border recovery

The European Payment Order covers cross-border claims, and EU judgments are enforced in Spain under Brussels Ia.
