File with the OEPM
National applications go to the OEPM (Oficina Española de Patentes y Marcas). An EU trade mark (EUTM) via the EUIPO covers all member states, and the Madrid Protocol extends protection internationally.
Opposition-based examination
The OEPM examines absolute grounds on its own and notifies holders of earlier rights that a similar mark has been published, leaving them to file an opposition — earlier marks are not used to refuse the application automatically.
Classes and term
Applications use the Nice Classification, and registration lasts ten years, renewable.
For foreign brand owners
Because relative grounds depend on opposition, a clearance search and a watch service are worth having. A verified Spanish colleague can search, file with the OEPM, and monitor for conflicts.
